Etimaps Terms of Use — Working Draft

Private version 1. These Terms are not yet effective. Before publication, complete the operator, eligibility, governing-law, resource-ownership, deletion, liability, and launch-country decisions and obtain an appropriate legal review.
1. Who provides Etimaps?
Etimaps is operated by [operator’s legal name, legal form, and postal address — to be completed before publication] (“Etimaps”, “we”, “us”).

2. Accepting these Terms
These Terms govern use of the Etimaps application, website, Etimaps Cloud, and related services. By creating an account or using Etimaps Cloud, you agree to these Terms. Local features that do not require an account remain subject to the provisions that concern the application, acceptable use, intellectual property, and liability.
If you do not agree, do not create an account or use Etimaps Cloud.
3. Eligibility
You must be legally able to enter into these Terms and meet the minimum age that will be stated here before publication. If you use Etimaps for an organization, you confirm that you are authorized to bind that organization to these Terms.
4. Local use and Etimaps Cloud
Etimaps is local-first. You can import files and create local maps and datasets without an account. Local data remains under your control on your device.
Saving a map or dataset to Etimaps Cloud is an explicit action. Cloud features may include backup, synchronization, sharing, invitations, roles, and collaborative editing. You are responsible for keeping any local copies or exports that you need.
5. Accounts and security
Provide accurate account information and keep access to your email address and sign-in methods secure. You are responsible for activity performed through your account unless you promptly notify us that it has been compromised.
Do not share authentication credentials, attempt to use another person’s account, or bypass access controls. Contact contact@etimaps.com if you believe your account or a Sharing group has been accessed without authorization.
6. Your content
You keep ownership of the maps, datasets, files, titles, configurations, and other content that you lawfully provide to Etimaps (“Your Content”).
You grant Etimaps a limited, non-exclusive licence to host, copy, process, transmit, display, and technically modify Your Content only as needed to provide, secure, maintain, and improve the features you choose to use. This licence ends when the relevant content is deleted, except for temporary recovery copies and content that another authorized member is independently entitled to retain under the final Sharing-group ownership rules.
You confirm that you have the rights and lawful basis needed to import, store, and share Your Content, including any personal data or third-party material it contains. Etimaps does not acquire ownership of Your Content merely because it is stored in Etimaps Cloud.
7. Sharing groups, roles, and invitations
A Sharing group controls access to one or more map views and datasets. Members’ abilities depend on server-enforced roles and capabilities.
Owners and authorized managers are responsible for choosing members, roles, invitations, and resources carefully. Moving a resource, changing a role, removing a member, leaving a group, or deleting a group may change or remove other people’s access.
The final Terms will define when a resource is personal, when it belongs to a Sharing group, how ownership may be transferred, and what happens when the final owner leaves or deletes an account. Until those rules are finalized, Etimaps is not intended for irreplaceable or regulated shared data.
8. Acceptable use
You must not use Etimaps to:
- break the law or violate another person’s rights;
- upload or share content you are not entitled to use;
- unlawfully process, expose, sell, or distribute personal data;
- distribute malware or interfere with the security or operation of Etimaps;
- attempt to gain access to accounts, Sharing groups, maps, datasets, systems, or capabilities you are not authorized to use;
- probe, scrape, overload, reverse engineer, or circumvent rate limits or technical protections except where applicable law expressly permits it; or
- use Etimaps to threaten, harass, defraud, or cause harm.
We may restrict access to content or accounts when reasonably necessary to protect users, comply with law, investigate abuse, or secure the service.
9. Privacy
The Etimaps Privacy Policy explains how personal data is processed. It forms part of the information provided with these Terms but is a separate document.
10. Service availability and changes
We aim to provide a reliable service, but Etimaps may be unavailable because of maintenance, security incidents, network failures, provider outages, or product changes. Features may change as the product develops.
Unless Etimaps expressly agrees otherwise in writing, Etimaps Cloud is not an archival or disaster-recovery service. Keep independent copies of data whose loss would cause significant harm.
We will provide reasonable notice when a material change would significantly reduce a paid or essential cloud feature, except when an urgent security or legal issue requires faster action.
11. Account deletion and termination
You can initiate account deletion in the app. The account becomes inactive immediately and remains recoverable for 30 days before scheduled permanent cleanup. The final deletion rules for personal and group-owned resources will be stated before these Terms become effective.
We may suspend or terminate access when you materially breach these Terms, create a security risk, fail to remedy abuse, or when continued service would violate the law. Where reasonable, we will provide notice and an opportunity to export eligible content.
12. Third-party services
Etimaps may rely on services supplied by Cloudflare, Apple, Google, and other disclosed providers. Third-party services are governed by their own terms and privacy practices. Etimaps is not responsible for changes or outages in services it does not control, subject to rights that cannot lawfully be excluded.
13. Etimaps software and branding
Etimaps and its licensors own the application, website, service code, designs, documentation, trademarks, and other materials that are not Your Content. These Terms give you a personal, limited, revocable, non-transferable right to use the service as intended. They do not transfer any Etimaps intellectual-property rights to you.
14. Warranties
Etimaps is provided with the level of care required by applicable law. Except for rights and warranties that cannot lawfully be excluded, the service is provided without additional guarantees that it will always be uninterrupted, error-free, or suitable for a particular professional, safety-critical, or regulated use.
Nothing in these Terms limits mandatory consumer rights.
15. Liability
The final liability wording and any financial limitation will be adapted to the operator, business model, and governing law before publication.
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud, wilful misconduct, or any mandatory consumer remedy.
16. Governing law and disputes
The governing law, competent courts, consumer dispute information, and any mandatory local rights will be completed after the operator’s country and initial launch territories are confirmed.
17. Changes to these Terms
We may update these Terms as Etimaps changes. We will update the date above and provide reasonable additional notice before a material change takes effect. Continuing to use Etimaps after the effective date of an updated version means that version applies, to the extent permitted by law.
